1. Acceptance of these terms
These Terms of Service (the “Terms”) are a binding agreement between you and Onkod, LLC, a Texas limited liability company (“Onkod,” “we,” “us,” or “our”). They govern your access to and use of the NewSelfTalk mobile application, the website at newselftalk.com, and any related services we provide (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What NewSelfTalk is
NewSelfTalk is a personal-wellness app that lets you write, record, and listen to short affirmations in your own voice or an AI-rendered voice, optionally layered with ambient audio. It is a self-directed tool. It is not therapy, counseling, or medical care. See section 9 for more on this.
3. Eligibility
NewSelfTalk is intended for a general adult audience and is not directed at children. You must be at least 13 years old to use the Service. If you are under the age of majority where you live (typically 18), you may only use the Service with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf. By using the Service you represent that you meet these requirements.
4. Your account and your recordings
You may use the Service without creating a cloud account; in that case your recordings stay on your device. If you choose to back up your recordings or sync across devices, you are responsible for the security of your device, your Apple ID, and any credentials used to access the Service.
You retain all ownership of the audio, text, and other content you create or upload through the Service (“Your Content”). You grant Onkod a limited, non-exclusive, royalty-free license to store, process, transmit, and display Your Content solely to operate the Service for you (for example, to play back your recordings, render a session, or sync across your own devices). We do not sell Your Content, use it to train models, or share it except as needed to provide the Service or as required by law.
5. Subscriptions, billing, and cancellation
Parts of the Service are free. Some features require a paid subscription, sold through the Apple App Store. When you purchase a subscription, Apple bills the payment method on your Apple ID, and Apple’s terms govern payment, renewal, cancellation, and refunds.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- You can manage or cancel a subscription in your Apple ID settings.
- Refund requests are handled by Apple; Onkod cannot issue refunds for App Store purchases.
- Free trials, if offered, convert into a paid subscription at the end of the trial unless canceled first.
6. Acceptable use
You agree not to use the Service to:
- Break any applicable law or regulation.
- Record, upload, or distribute content that infringes intellectual-property rights, defames a person, harasses or threatens anyone, or is otherwise unlawful.
- Record or distribute another person’s voice or likeness without their consent.
- Reverse-engineer, decompile, scrape, or otherwise attempt to extract the source code of the Service, except where that restriction is prohibited by law.
- Interfere with the Service, its servers, or the networks connected to it, or attempt to bypass rate limits or authentication.
- Use the Service to build a competing product.
We may suspend or terminate access to the Service if you violate these rules.
7. Our intellectual property
Onkod and its licensors own the Service, including the NewSelfTalk name and logo, the app and website designs, the curated starter affirmation library, AI voice models we provide, and all underlying code. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use. All rights not expressly granted are reserved.
8. Privacy
Our Privacy Policy explains what we collect, how we use it, and your choices. By using the Service you agree to the practices described there.
9. Wellness disclaimer — not medical advice
NewSelfTalk is a self-improvement and mindfulness tool. It is not a medical device, diagnostic tool, therapist, or substitute for professional mental-health, psychological, or medical care. The Service does not diagnose or treat any condition and makes no claims of therapeutic outcome.
If you are in crisis or considering harming yourself or others, stop using the Service and contact emergency services or a qualified professional. In the U.S., you can call or text 988 for the Suicide & Crisis Lifeline. Always consult a qualified professional about any mental-health or medical concern.
10. “As is” — disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or accuracy of AI-generated output. We do not guarantee that the Service will be error-free, that defects will be corrected, or that any specific result will follow from its use.
11. Limitation of liability
To the maximum extent permitted by law, Onkod and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or in connection with the Service, even if we have been advised of the possibility. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid Onkod for the Service in the twelve months before the claim, or (b) US $100. Some jurisdictions do not allow certain of these limitations; in those places, our liability is limited to the smallest extent permitted.
12. Indemnification
You agree to defend, indemnify, and hold Onkod harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service at any time by deleting the app and, if applicable, canceling your subscription through the App Store. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or if continuing to provide the Service to you would create legal or safety risk. Sections that by their nature should survive (for example, ownership of Your Content, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
14. Changes to these terms
We may update these Terms from time to time. If a change is material, we’ll give reasonable notice, for example by an in-app message or a notice on the website, before it takes effect. Your continued use of the Service after the effective date means you accept the updated Terms. If you don’t accept them, stop using the Service.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and Onkod agree that any dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction there. Nothing in this section limits any right you have that cannot be waived under applicable law.
16. Miscellaneous
If any part of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them, for example in a merger or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Onkod about the Service.
